Bill Cosby: prosecutor plans new trial as jury scuppers sexual assault case

Judge declares mistrial in Cosby's sexual assault case

The accuser in the case is Temple University employee Andrea Constand, who was a guest at Cosby's house in Cheltenham Township on an evening in January 2004.

Yes. If he had been convicted, prosecutors say Cosby would have had to register as a sex offender and face an assessment to determine whether he was a sexually violent predator.

Cosby never took the stand himself, but Friday night he spoke publicly for the first time since the trial began.

Cosby was accused of drugging and sexually violating Andrea Constand at his suburban Philadelphia home in 2004.

The District Attorney said he vows to retry the case.

The trial lasted for just six days and the funnyman did not testify.

Cosby will remain free on $1 million bail.

Her case is the only criminal prosecution against Cosby out of the more than 50 women who have accused the comedian of sexual misconduct and/or drugging. The comedian said in depositions that he gave her the common allergy drug Benadryl and insisted she was a willing participant in the "petting" that followed. He says it was consensual.

But the jurors struggled with their verdict, telling the judge on day four of the trial that they were at impasse.

It was unclear how close the jury was to reaching a decision.

While Steele may have concern for the victim, Cosby's wife Camille did not mention her, or her husband, in a statement read outside court.

"This jury is hopelessly deadlocked", he said.

The judge in the trial could soon hear a petition to release juror names. Mr. McMonagle for his passionate and powerful articulations of truth; Ms. Agrusa for her thorough research to bolster counsel McMonagle; to Mr. Andrew Wyatt for his unequivocal skills in public relations; to our team, who worked diligently and intelligently; to our staffs for their continuous commitment to our family and me.

Powerhouse attorney Gloria Allred represents some of the alleged victims in civil court and she warned the star not to celebrate just yet.

As for Cosby, she had another message for him. A judge declared a mistrial Saturday. "It's not over yet, Mr. Cosby".

In addition to proving that Cosby assaulted them, Smolla said, they would have to establish that he said something about them beyond denying the allegations, such as calling them known liars or promiscuous.

Bill Cosby's publicist speaks out. Cosby pleaded not guilty to the charges.

Dunham went onto send her thoughts to women effected by sexual assault stating 'My heart is with every survivor reliving the erasure of their own experience today.

"It's extremely emotional", said Jewel Allison, a NY woman who has said that Cosby assaulted her, as she prepared to leave the courthouse.

Two women jurors who appeared to be in their 30s or 40s looked anguished when they announced the final deadlock, wiping away tears with tissues handed to them by a sympathetic young man sitting between them.

Cosby is charged with three counts of aggravated indecent assault that could put him in prison for the rest of his life.

Criminal law professor Jody Armour wonders if the bitter divide over social issues that's evident in American politics was at work in the jury room.

McMonagle said asking Cosby to surrender had been hard.

The jury deliberated for 54 hours; longer than the trial itself.
